VOCAL POCKETS ACCEPTABLE USE POLICY

This Acceptable Use Policy ("AUP") is a Policy under, and is incorporated into, the Vocal Pockets Terms of Use ("Terms"), currently accessible at vocalpockets.com/pages/terms-of-use. Capitalized terms not defined in this AUP have the meanings given in the Terms.

This AUP may be updated by Vocal Pockets from time to time in accordance with Section 18(b) of the Terms. Violation of this AUP constitutes a violation of the Terms.

1. General Prohibitions.

You may not, and may not permit or assist any third party to, use the Platform to:

(a) violate, or encourage the violation of, the legal rights of others;

(b) engage in, promote, or facilitate any illegal, fraudulent, deceptive, or harmful activity;

(c) infringe, misappropriate, or violate any intellectual property right, privacy right, or right of publicity of any person or entity;

(d) harass, abuse, threaten, or harm any other person;

(e) transmit any virus, malware, or other code intended to damage, disrupt, or gain unauthorized access to any system, device, or data; or

(f) gain or attempt to gain unauthorized access to any account, system, device, or data, whether belonging to Vocal Pockets, another user, or any third party.

2. Account Integrity.

(a) No Sharing. You may not share, transfer, sell, sublicense, or otherwise make available your account, login credentials, or access rights to any other person, except as expressly permitted by the Terms or the applicable Plugin Supplemental Agreement.

(b) No Multiple Accounts to Exploit Offers. You may not create or maintain multiple accounts for the purpose of obtaining additional trial periods, promotional offers, beta access, or other benefits intended to be limited to a single user.

(c) Accurate Information. You must provide accurate and current information when creating an account and must promptly update such information if it changes.

(d) Unauthorized Distribution. You may not distribute, post, upload, or otherwise make available any Software installer or related files to any third party through any means, including file sharing services, cloud storage, messaging platforms, or public repositories. Any person who obtains Software through an unauthorized distribution is not licensed to use it.

3. Device and Entitlement Circumvention.

You may not:

(a) spoof, alter, falsify, or otherwise manipulate any device identifier used to enforce device limits or licensing restrictions;

(b) circumvent, disable, bypass, or interfere with any license enforcement, entitlement verification, heartbeat, device lease, or similar mechanism in any Software;

(c) exceed the device limit specified in the applicable Plugin Supplemental Agreement through any technical or other means; or

(d) falsify or manipulate any subscription status, credit balance, or other account entitlement.

4. Automated Access and Bots.

You may not use any automated means, including bots, scripts, scrapers, macros, or other programmatic tools, to:

(a) access, interact with, or extract data from the Platform, except as expressly permitted by an applicable Plugin Supplemental Agreement;

(b) create accounts, redeem promotional offers, or generate content at a scale or pace inconsistent with ordinary individual human use;

(c) systematically scrape, harvest, index, or extract Moodscape Content, Generated Output, pricing information, or any other content from the Platform; or

(d) circumvent any rate limit, credit consumption mechanism, or other usage control implemented by Vocal Pockets.

5. Credit System Integrity.

You may not:

(a) manipulate, exploit, or attempt to exploit any vulnerability in the credit ledger, idempotency mechanism, or credit consumption system to obtain credits or generations you have not paid for;

(b) use chargebacks, payment disputes, or refund requests in bad faith to retain access to credits, content, or features while avoiding payment; or

(c) resell, transfer, or monetize access to credits or AI generation capacity to any third party, including operating the Software as a back-end service to generate content on behalf of paying third parties.

6. Content Library Misuse.

You may not:

(a) extract, copy, decrypt, or attempt to access Moodscape Content or other licensed content library assets outside of the Software in which they are provided;

(b) redistribute, publish, or make available any Moodscape Content or other licensed content library assets to any third party; or

(c) use any automated tool to systematically download, cache, or archive Moodscape Content or other licensed content library assets beyond ordinary use of the Software.

7. AI and Machine Learning Misuse.

In addition to the AI and Machine Learning Restrictions set forth in Section 7(b) of the Terms, you may not use the Platform to:

(a) submit prompts, inputs, or systematic queries designed to extract, reconstruct, or reverse engineer any underlying AI model, training data, or system architecture;

(b) generate content at automated scale for the purpose of building a dataset, corpus, or training set; or

8. Commercial Misuse.

You may not:

(a) resell, sublicense, or distribute access to the Platform, any Product, or any Software to any third party, except as expressly permitted by the Groove License or an applicable Plugin Supplemental Agreement; or

(b) use the Platform to develop, train, or improve any product or service that competes with the Platform or any Vocal Pockets product.

9. Enforcement.

(a) Investigation. Vocal Pockets may investigate any suspected violation of this AUP, including by reviewing account activity, device records, and usage logs.

(b) Remedies. Vocal Pockets may take any action it deems appropriate in response to an actual or suspected violation of this AUP, including without limitation issuing a warning, suspending or terminating access to the Platform, revoking device leases, forfeiting unused credits, and pursuing any other remedy available under the Terms or applicable law.

(c) No Refund. Credits, Subscription fees, and other amounts paid are not refundable in connection with any suspension or termination resulting from a violation of this AUP, except as required by applicable law.

(d) Reporting Violations. If you become aware of a violation of this AUP, you may report it to team[at]vocalpockets.com.

10. Changes to This Policy.

Vocal Pockets may update this AUP at any time in accordance with Section 18(b) of the Terms. The "Last Updated" date above reflects the most recent revision.
